2. The petitioner seeks bail bail in Sasaram (Town) P.S. Case No. 797 of 2024 instituted for the offences under Sections 126(2), 76, 351(2) and 79 of BNSS and Sections 4, 8 and 12 of the POCSO Act pending in the Court of District & Additional Sessions Judge-VI-cum-Exclusive Special Court (POCSO) Rohtas at Sasaram. He has no criminal antecedent.
3. The Trial Court Report was called by this Court with regard to the present stage of trial. It reveals from the report of the learned Trial Court, i.e., District & Additional Sessions Judge-VI-cum-Exclusive Special Court (POCSO)
Patna High Court CR. MISC. No.88077 of 2024(7) dt.26-06-2025 2/2 Rohtas at Sasaram dated 17.05.2025 that out of nine chargesheet witnesses seven have been examined and two witnesses remains to be examined and the next date for prosecution evidence was fixed on 27.05.2025.
4. In view of the report of the learned trial Court and considering the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
5. The learned trial Court, i.e., District & Additional Sessions Judge-VI-cum-Exclusive Special Court (POCSO) Rohtas at Sasaram is directed to expedite the trial and complete the same within a period of three months from today.
6. It goes without saying that the learned Trial Court shall take note of the fact that the delay should not be on account of the prosecution side.
