Petitioner is apprehending his arrest in connection with Rajnagar P.S. Case No.292 of 2024, registered for the offence punishable u/s 309(6) of B.N.S, 2023.

The allegation against the petitioner is that the petitioner alongwith other accused person assaulted the informant. They demanded mobile and other articles from the informant and threatened her.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case. Nobody sustained injury in this incident. One person was apprehended and the apprehended person disclosed the name of this petitioner.

Learned APP for the State opposed the prayer for bail. 6.

Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

7. However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order.

This application is accordingly dismissed.
