====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 17-01-2025 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Alamnagar P.S. Case No.246 of 2023, registered for the offences punishable under Sections 364, 302, 201, 34 of the Indian Penal Code.

3. As per the prosecution case, four named accused persons forcibly took the son of informant with them from his house and brutally assaulted him and demanded ransom. When the informant with his family members went at the Basa of the co-accused Santosh Patel, it was found that the accused persons assaulting the victim by tying him in a tree and at that place petitioner, co-accused Suraj Patel, Bittu Sah and other 10-15 persons were also present. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to ulterior motive. He further submits that there is no allegation of any overt act against the petitioner, except he was the member of mob. Learned counsel submits that there is delay in filing the F.I.R. and except the suspicion there is no material against the petitioner. He further submits that petitioner has three criminal antecedents, out of which, one case belongs to Excise Act and he is on bail in all the cases. Learned counsel submits that petitioner is in custody since 18.07.2024, charge sheet has already been submitted in this case and there is no chance of tampering with the evidence. Petitioner undertakes to cooperate in the trial of the case.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st
