Petitioner seeks bail in a case initially registered under Section 379 of Indian Penal Code but later on added with Sections 328, 396, 412, 413, 120B of Indian Penal Code. It is submitted on behalf of the petitioner's counsel that the petitioner is entitled to parity with the other co-accused persons who have also been implicated in this case on the basis of information gathered by spy and statement of co-accused Veera Choudhary. Reliance is placed on the orders passed by this Court in Cr Misc No 12797 of 2018 in the case of Dashrath Rai, Cr Misc No 14479 of 2018 in the case of co-accused Rakesh Kumar @

Patna High Court Cr.Misc. No.21377 of 2018 (4) dt.23-05-2018 2/2 Rakesh Barnwal @ Rakesh Kumar Barnwal and Munna Prasad. Petitioner's counsel also relies upon the order passed by this Court granting bail to co-accused Dipak Singh in Cr Misc No 17830 of 2018. The petitioner is having clean antecedent and is in custody since 13.12.2017.

Considering the aforesaid submissions, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in Manjhagarah Police Station Case No 272 of 2017 dated 25.11.2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
