2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 103(1), 3(5) and 108 of the Bharatiya Nyaya Sanhita, 2023.
3. As per prosecution case, son of informant was married with the petitioner in the year 2023. After marriage, petitioner used to quarrel with informant's son. Petitioner called her mother and went to her Mayke and lodged false case against informant's son. On 16-08-2024 at about 7:00 PM petitioner and her family members called him via phone at Lachhuar and assaulted him with lathi and administered poison due to which he started feeling unwell. Thereafter, they took him to Shekhpura Hospital and called informant and his family from phone of Nitish Das. When informant arrived there the accused/petitioner and co-accused ran away from there. Nitish Das was referred to Sadar Hospital Patna and he died while reaching Lakhisarai.
4. Learned counsel appearing for the petitioner
Patna High Court CR. MISC. No.81923 of 2025(2) dt.02-12-2025 2/2 submits that from perusal of the FIR itself it is clear that informant is not an eye witness to the occurrence and due to matrimonial dispute, she has falsely been implicated in this case. As a matter of fact, informant's son committed suicide and petitioner was not in touch with deceased since her return from the matrimonial house. Charge sheet has already been filed. Petitioner claims clean antecedent and she is in custody since 26.7.2025.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the nature of accusation, materials collected during investigation and period of custody of the petitioner who is a lady, prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Jamui in Lachhuar Police Station Case No. 143/2024.
