The petitioner seeks bail in Wazirganj P.S. Case No.135 of 2016, corresponding to S.T. No.34/19/133/17, registered under Sections 304(B), 120(B) and 34 of the Indian Penal Code.

The gist of the allegation is that the petitioner, husband of the deceased, and others killed the cousin of the informant, Chhoti Kumari and when the informant went to the house of his sister, her dead body was found lying on the verandah. A black ligature mark was found all around the neck of the deceased.

Learned counsel for the petitioner submits that the petitioner is innocent. The deceased fell ill and she was being taken to hospital but she died on her way to hospital, but it

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

Since the petitioner is in jail for more than three years, the trial court is directed to hold the trial on day to day basis and conclude the same within six months from the date of receipt of this order.

The S.S.P., Gaya is directed to ensure the attendance of the prosecution witnesses in the trial court so that the trial must be concluded within six months.
