JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 The petitioners seek anticipatory bail in connection with Mahindwara P.S. Case No. 70 of 2019, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. Allegation against the petitioners and others is of assault to the informant.
It has been submitted on behalf of the petitioners is that there is case and counter case between the parties and injury sustained by the informant was found simple in nature, which will appear from Annexure -2, 3 and 4.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts,
Patna High Court CR. MISC. No.76654 of 2019(3) dt.11-12-2019 2/2 this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Mahindwara P.S. Case No. 70 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
