2. The petitioner apprehends his arrest in connection with Siwan Muffasil Mahadeva O.P. P.S. Case No. 624 of 2023 registered for the offence under Sections 413, 414/34 of I.P.C.

3. As per the prosecution case, petitioner is alleged to have stolen a motorcycle.

4. It has been submitted by the learned counsel for the petitioner that the petitioner had purchased the motorcycle since it was a stolen motorcycle, he has falsely been implicated in this case. Petitioner is working in Gulf country and has clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan/ concerned Court below in connection with Siwan Muffasil Mahadeva O.P. P.S. Case No. 624 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.

8. This is also subject to the condition that at the time of furnishing bail bond, the petitioner will produce the documents to show that he has been working in a Gulf country and if the court below finds that he is working there, his bail bond will be accepted otherwise the bail bond of the petitioner will be cancelled and he shall be taken into custody.
