The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 420 and 120(B) of the Indian Penal Code and Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016. Liquor was not recovered from the possession of the petitioner nor the petitioner was present there at the time of alleged occurrence. The name of the petitioner has transpired on the basis of confessional statement of co-accused. Petitioner has stated on oath that he has got clean antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender in the court below within a period of thirty

Patna High Court CR. MISC. No.79029 of 2019(2) dt.04-12-2019 2/2 days from the date of receipt of the order, on furnishing bail bond of Rs.20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Muzaffarpur in connection with Saraiya P.S.Case No.385 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
