2. The petitioner is in judicial custody in connection with Parbatta P.S. Case No. 107 of 2024 for the offence punishable under Section 366 of the Indian Penal Code lodged on 20.06.2024 by the informant, Neeraj Kumar.
3. As per the prosecution story, the informant alleged that his sister was missing and it came to notice that she used to talk to this petitioner and he was warned from doing so. He has apprehension that Sintu Kumar has taken away the girl. Accordingly, the FIR/arrest.
4. Learned counsel for the petitioner submits that both were major, if there was any relationship, it was consensual, he do not have any video of the relationship and if such statement
Patna High Court CR. MISC. No.84047 of 2024(7) dt.16-05-2025 2/3 is found to be incorrect, if granted relief, the steps can be taken for cancellation of the bail bond. He shall be diligently appearing in trial, the trial is not likely to be concluded and is in custody since 21.06.2024 and shall in no way try to coerce or harass the lady.
5. Learned counsel for the petitioner informant submits that promising marriage, he made relationship and an undertaken was also given on 11.12.2024 which stood incorporated in the order.
6. Learned counsel for the petitioner submits that the earlier counsel though made submission, no such instruction was given by the petitioner/family members.

The allegation is there, the FIR has also been lodged, he will face the trial, he is young boy, is in custody since 21.06.2024, this Court has recorded that he has no objectionable material of the lady with him and if the said information/undertaking is incorrect and any untoward photo/video comes to the public domain, the lady shall be fully entitled to take immediate steps for cancellation of his bail bond as also to take appropriate steps for lodging fresh case.
6. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of
Patna High Court CR. MISC. No.84047 of 2024(7) dt.16-05-2025 3/3 like amount each to the satisfaction of learned A.C.J.M.-III, Naugachia, Bhagalpur, in connection with Parbatta P.S. Case No. 107 of 2024 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
