JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2019 The petitioner seeks bail in connection with Kundwa Chainpur P.S. Case No. 51 of 2019 which has been instituted for the offences under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 41(1) of the Bihar Prohibition & Excise Act, 2016.

Two persons were spotted by the police party moving on a motorcycle in a suspicious circumstance. The motorcycle was chased but one person managed to escape. From the arrested person viz. Rakesh Kumar,

Patna High Court CR. MISC. No.76825 of 2019(2) dt.11-12-2019 2/3 252 litres of nepali liquor is stated to have been recovered. Aforesaid Rakesh Kumar named one Dipesh Kumar as having run away on seeing the police party. It has also been stated by aforesaid Rakesh Kumar that the consignment was meant to be delivered to the petitioner.

Learned counsel for the petitioner has submitted that at best his implication in the present case is only on the basis of confession of an arrested accused person. Aforesaid Rakesh Kumar is stated to have been granted bail by a Bench of this Court.

The petitioner is in custody since 01.10.2019 and in the cases in which he was made accused earlier, he has been granted bail.

Considering all these facts, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East
