The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.
The petitioner is apprehending his arrest in a case registered under Sections 406, 420, 465, 466, 467, 468, 469, 471, 472, 474, 120(B) of the Indian Penal Code. Accusation is that a sting operation was conducted and the same was displayed on the News 18 with regard to corruption in Bihar Cricket Association by Secretary, members of Senior Selection Committee and logistic manager-umpire (the petitioner) and Selection Committee of Bihar Cricket
Patna High Court CR. MISC. No.79771 of 2019(4) dt.07-09-2020 2/3 Association has selected player on accepting huge amount. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner happens to be the logistic manager. He has got no concern with the Selection Committee. He is not involved in process of selection of players. He has no role to play in the same. Due to internal politics, the petitioner has been made accused in the present case. Other co-accused has been granted bail vide Annexure 5 to the present application by a co-ordinate Bench of this Court.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of eight weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Shri Rajeev Nayan, Sub Judge XVII-cum-Additional Chief Judicial Magistrate, Patna in connection with Gandhi Maidan P.S. case
