2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 366-A and 34 of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.

The case of the prosecution is that the daughter of the informant, namely, Puja Kumar aged about 17 years had gone to Bank and when she did not return for a considerable moment, informant came to know that someone has forcibly boarded her in a bike and has gone to somewhere. He also came to know that Rahul Kumar and others have kidnapped his daughter for the purpose of marriage.

4. Learned counsel for the petitioner submits that the

It is further submitted that during the course of investigation, the victim has recovered and victim has given her statement under Section 164 of the Cr.P.C. wherein she has stated that she has gone to Bangalore with Rahul Kumar in her own will. Further submission is that the matter has already compromised between the parties. Moreover, the petitioner is languishing in judicial custody since 12.09.2024 having no criminal antecedent.

5. Learned counsel for the informant submits that the matter has compromised between the parties.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rajaoun (Nawada) P.S. Case No. 190 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -6 cum Special Judge, POCSO, Banka.
