The petitioner is languishing in custody since 01.10.2019 in a case registered for the offences punishable under Sections 436, 380/411/34 of the Indian Penal Code. The prosecution case as per the informant, Veena Devi is that she along with her husband is living at Kolkata and her house situated at Darbarbhanga is closed. It is alleged that when the informant reached her house at Darbhanga she saw fire in the house which was extinguished when the house was inspected then she found that the jewellery and clothes were missing from the house, leading to registration of the FIR against unknown. During investigation the name of the petitioner sprang up on the statement of co-accused Pankaj Kumar Jha.

No.74697 of 2019(2) dt.04-12-2019 2/2 It is submitted by learned counsel for the petitioner that there is no recovery from the possession of the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the name of the petitioner sprang up on the confessional statement of co-accused Pankaj Kumar Jha.

Considering the fact that there is no recovery from the possession of the petitioner and investigation being concluded, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Darbhanga in connection with Manigachhi P.S. Case No. 205 of 2019.
