The petitioners are languishing in custody since 29.09.2019 in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that 60 litres of Mahua liquor was recovered from the motorcycle of the petitioners. It is submitted by learned counsel for the petitioners that the petitioners are not having any criminal antecedent, statement to that effect has been made in paragraph 3 of the petition.

Patna High Court CR. MISC. No.77260 of 2019(2) dt.04-12-2019 2/2 Learned APP submits that the recovery has been made from the motorcycle of the petitioners.

Considering the quantity of recovery, coupled with the statement made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum- Special Judge, Saran at Chapra in connection with Kopa P.S.
