JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Chhatapur Rajeshwari O.P. P.S. Case No. 127 of 2019 registered for the offences punishable under Sections 457, 380 and 34 of the Indian Penal Code.

Petitioner is named in the FIR and there is allegation he was taking away the box containing cash and ornaments of the informant.

Submission of learned counsel for the petitioner is that allegation appears to be false as there is no source of light in which identification was made and occurrence took place at night.

Heard learned APP also.

In view of above facts and circumstances, I am not

Patna High Court CR. MISC. No.74200 of 2019(2) dt.21-11-2019 2/2 inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered without being prejudiced by this order.

This application is, accordingly, dismissed.
