Petitioner apprehends his arrest in connection with Samastipur Mahila P.S. Case No.55 of 2022 dated 28.07.2022, registered for the offence punishable u/s 366(A), 363, 506, 34 of the IPC and section 18 of the POCSO Act, pending in the Court of learned Additional Sessions Judge- VI - cum- Special Court, POCSO, Samastipur, Bihar.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the

Patna High Court CR. MISC. No.84271 of 2023(3) dt.15-05-2024 2/2 learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that one of the co-accused namely Raushan Kumar has been granted regular bail by the court below itself.
