2. Petitioner apprehends his arrest in connection with Excise Case No. 104 of 2020 dated 29.04.2020, registered for the offence punishable u/s 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018, pending in the court of learned Special Judge, Excise-02, Samastipur.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if petitioner surrenders before the learned Court below within six weeks from today and seeks regular bail,
