The petitioner seeks bail in Paraiya P. S. Case No. 149 of 2019 instituted for the offence under Section(s) 341, 342, 323, 504, 384 and 385/34 of the Indian Penal Code. It is submitted by the petitioner's counsel that since the petitioner was objecting the illegitimate activities of the informant being carried out in the village, he has falsely been implicated in the instant case. None of the articles alleged to have been snatched have been recovered either from the petitioner's house or person.

The petitioner has no criminal antecedents, as per averments made in paragraph No.3 of the bail petition. Petitioner is in custody since 21.09.2019.

No.75072 of 2019(2) dt.25-11-2019 2/2 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-III,Gaya, in connection with Paraiya P. S. Case No. 149 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled (Madhuresh Prasad, J) shyambihari/- U T
