2. The petitioner seeks bail in connection with Tikapatti P.S. Case No. 62 of 2023 registered for the offence under Sections 341, 323, 504, 448, 308, 379/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have assaulted the victim.

4. The petitioner is in jail from 17.9.2023.

5. Learned counsel for the informant has opposed the application of the petitioner and he has produced a copy of the order dated 9.1.2023 passed in Criminal Appeal (DB) No. 725 of 2022 in which the petitioner is appellant no. 4. Last part of the order dated 9.1.2023 reads as follows:-

Patna High Court CR. MISC. No.84531 of 2023(4) dt.19-03-2024 2/2 "As a condition of this order, the appellants should co-operate this Court in disposal of the appeal and they should not repeat commission of similar offences in future. Till disposal of the appeal, recovery of file is stayed."

6. Considering the trivial dispute and also considering the fact that the case is registered under Section 308 and other Sections of the IPC, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Purnea in connection with Tikapatti P.S. Case No. 62 of 2023.
