The petitioner is in custody since 15.09.2019 in connection with Nawada P.S. Case No.957 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from the house which is a joint family property. It is further submitted that there is no independent witness to support the prosecution case. It is further submitted that the petitioner is not having any criminal antecedents.
