JUSTICE SHAILENDRA SINGH ORAL ORDER 02-12-2025 The instant writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking the following relief(s):- " 1. That this is an application for issuance of writ in the nature of Mandamus commanding the Respondent no.4 for digitalization of left out Jamabandi Number 507 bearing Old Khata no.554, New Khata no.702 and Old Khesra no.2535 and New Khesra no.4217, 4220, 4222, 4226 and total area-74 decimal in Mauza Ratanpura, Thana no. 30."

2. Mr. Kumar Vishoka Nand, learned counsel for the petitioner and Mr. Sarvesh Kumar, learned GP-24 for the Staterespondents are present and they are heard.

The main grievance raised by the petitioner is that his online application for digitalization of the left-out Jamabandi No. 507 pertaining to Old Khata No. 554, New Khata No. 702, and Old Khesra No. 2535 and New Khesra Nos. 4217, 4220, 4222, and 4226, relating to land measuring 74 decimals situated in Mauza Ratanpura, Thana No. 30, is still pending despite having been filed on 20.04.2025.

4. This Court is of the view that the issue raised by the petitioner is premature for consideration under the writ jurisdiction of this Court. However, the Circle Officer, Ghailarh, Madhepura (Respondent No. 4), is directed to look into the petitioner's grievance (Annexure-P/3) and take necessary legal steps for redressing the same within two months from the date of this order.

5. The petitioner will have the liberty to make a fresh online prayer in respect of the digitalization of his left-out Jamabandi, if such an application is filed then Respondent No. 4 shall decide the same at the earliest, and in any case within two months from the date of its filing.
