====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 08-05-2018 Heard Sri Virendra Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 31.01.2018 having clean antecedent, which fact has been stated in paragraph-3 of the petition, has prayed for grant of bail in Dumra P.S. Case No.37 of 2018 registered for the offence under Sections 272/273/414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, purely on the ground of parity.
It was submitted by learned counsel for the petitioner that along with two other accused persons, petitioner was apprehended on an allegation that Tavera vehicle, from which huge quantity of Indian Make Foreign liquor was recovered, was intercepted by the police and after seeing the police party,
Patna High Court Cr.Misc. No.24939 of 2018(3) dt.08-05-2018 2/2 accused persons started fleeing away, however three persons including the petitioner were arrested and two persons fled away. Out of three arrested persons, two have been granted bail by order dated 04.05.2018 passed in Cr.Misc.No.20496 of 2018. Considering the fact that other two co-accused persons, in similar circumstances, have been granted bail, there is no reason to refuse the same relief to the petitioner. Accordingly, let the petitioner, namely, Ram Lagan Thakur, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge, Excise Act, Sitamarh in connection with Dumra P.S.
