The petitioner seeks bail in connection with Kuchaikote P.S. Case No. 130 of 2024 instituted for the offence under Sections 365 & 366A of the Indian Penal Code. 3.

Prosecution case in short is that informant reported that his daughter was kidnapped on 18-02-2024, while out for shopping and despite searching, she was not found. The next day, he received a ransom call demanding Rs. 15 Lakh and he

It has been submitted on behalf of the petitioner that the petitioner is in custody since 19-102-2024. Petitioner bears no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. It is submitted that victim in her statement recorded under Section 183 of the BNSS, 2023 has herself deposed that she was in love with the petitioner since five years and she had gone with the petitioner at her own volition. Learned counsel next submits that victim has refused for her medical examination. There is no ingredient of Section 366A of the IPC against the petitioner. Charge sheet is submitted in this case. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Witnesses have supported the prosecution case.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing
