JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-06-2020 Heard learned counsel for the petitioner and learned counsel for the State via video conferencing. By way of the present application, the petitioner has sought for pre-arrest bail in connection with Naubatpur P.S. Case No.471 of 2018 registered for the offences punishable under Sections 302, 120B read with 34 of the Indian Penal Code and section 27 of the Arms Act.

Considering the gravity of the offence, the allegation made in the FIR and the statement of the witnesses recorded under Section 161(3) of the Cr.P.C. in paragraph 25, 26 and 27 of the case diary that the petitioner and others indiscriminately fired causing injury to the father of the informant as a result of which he died, I am not inclined to grant

Patna High Court CR. MISC. No.76619 of 2019(5) dt.19-06-2020 2/2 him pre-arrest bail. The application is rejected. In case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
