JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2018 Petitioner apprehends his arrest in connection with Bhagwanpur P.S.Case No. 131 of 2017 registered for the offences punishable under Sections 467, 468, 471, 420 and 120B/34 of the Indian Penal Code.

Allegation against the petitioner is that he has been appointed on the post of teacher on the basis of forged certificate and in certificate, father's name is different. Submission of learned counsel for the petitioners is that in the certificate name of father's name of petitioner has been mentioned as Sunil Roy instead of Sunil Ray and the certificate is Annexure-3 which shows father's name of other accused person. Further submission is that similarly situated co-accused persons have been granted anticipatory bail vide order dated 2.2.2018 passed in Cr.Misc.No. 5142 of 2017 and vide order dated 7.3.2018

Patna High Court Cr.Misc. No.32171 of 2018 (3) dt.28-06-2018 2/2 passed in Cr.Misc.No. 11178 of 2018 by other co-ordinate Benches of this Court Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, surrender within a period of six weeks from the receipt of this order and his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Bhagwanpur P.S.Case No. 131 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
