The petitioners seek bail in a case registered for the offence punishable under Sections 419, 420, 467, 468, 471 & 120B of the Indian Penal Code and Sections 30 (a), 38 (1) (2) & 41

(1) of the Bihar Prohibition and Excise Act, 2016. 1574 liters of foreign liquor is said to have been recovered from the container and the pickup van at the time of unloading the liquor in the pickup van from the said container and its driver and four other accused persons including the petitioners were apprehended.

It is submitted by learned counsel for the petitioners

Patna High Court Cr.Misc. No.24091 of 2018 (02) dt.30-04-2018 2/ 2 that no incriminating article has been recovered from the conscious physical possession of the petitioners. They have been falsely implicated in this case by the police merely on suspicion. They have no concern either with the seized liquor or the vehicles in question. They have been languishing in custody since 08.12.2017. Similarly situated co-accused, namely, Raj Kumar Sharma has been enlarged on bail by this Court in Cr. Misc. No.20446 of 2018 vide order dated 16.04.2018. In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Patliputra P.S. Case No. 427 of 2017.
