Learned counsel for the petitioner submits that on 15.09.1978, the petitioner was appointed in the lower division clerk and the petitioner superannuated on 31.12.2017 from the post of Correspondence Clerk from the office respondent No.5 the Executive Engineer Rural Works Department, Government of Bihar, Muzaffarpur. In view of the recommendation of 4th pay revision Committee, the petitioner is entitled for first time

Patna High Court CWJC No.23892 of 2019 dt.03-12-2019 2/2 bound promotion and thereafter, petitioner is entitled for 1st ACP and 2nd ACP and for redressal of his grievance, the petitioner filed series of representations before the respondent authorities, but the grievance of the petitioner has not been redressed till now.

In view of the submission of the learned counsel for the petitioner, this writ petition is disposed of with direction to the petitioner to file a fresh detail representation regarding his grievance before respondent No.3 the Engineer in Chief Rural Works Department, Government of Bihar, Patna within three weeks. The respondent No.3 Engineer in Chief Rural Works Department, Government of Bihar, Patna shall consider the representation of the petitioner within eight weeks, thereafter, in speaking order in accordance with law and if, he/she found the claim of the petitioner genuine, he/she shall ensure the payment to the petitioner without any further delay.

With the aforesaid observations and direction, this writ application is disposed of.
