The petitioner is languishing in custody since 16.08.2019 in a case registered for the offences punishable under Sections 379 and 411of the Indian Penal Code. The prosecution case is that the informant while talking on mobile phone was going from Mirza Galib road Gaya, but all of sudden accused snatched his mobile phone and tried to flee away, though on alarm being raised by the informant, he was caught hold by the nearby people. It is alleged that the snatched mobile phone was recovered from his possession.

It is submitted by learned counsel for the petitioner that the petitioner has been framed in the present case

Patna High Court CR. MISC. No.74686 of 2019(2) dt.04-12-2019 2/2 maliciously. A statement has been made in paragraph no.2 of the petition that apart from the present case, the petitioner is accused in two other cases.

Learned APP for the State submits that the petitioner was caught on the spot and robbed mobile phone was recovered from his possession.

Considering the investigation already being concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya, in connection with Civil Lines P.S. Case No. 377 of 2019.
