The petitioner seeks regular bail in connection with Harsidhi P.S. No. 325 of 2019, registered for the offence punishable under Sections 414 of the Indian Penal Code. The allegation is regarding the petitioner having been apprehended by the police with a motorcycle and when he was told to show the registration papers, he had failed to produce the same.

The learned counsel for the petitioner has submitted that the FIR has not been lodged for theft of motorcycle, the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, coupled with the fact that the petitioner is having a clean antecedent and he is languishing in custody since about four months, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P.S. Case No. 325 of 2019.
