Petitioner apprehends his arrest in a case registered under Sections 147, 148, 149, 341, 342, 323, 307, 411, 504, 506 of the Indian Penal Code.

Informant has filed a written complaint stating therein that on 05.01.2017 at about 3:00 PM while Panchayati was going on between the informant and accused Prabhu Sharan Kumar who did not agree with the decision of Panches and called 13-14 miscreants variously armed and they threatened informant to kill and one of the miscreants also opened fire but it did not hit the informant and he and three others fled away, however, six were arrested on the spot.

It has been submitted on behalf of petitioner that

Patna High Court CR. MISC. No.76024 of 2019(2) dt.26-11-2019 2/2 he is not named in the FIR. His name has surfaced in this case during investigation and he has been roped in this case due to village rivalry and animosity. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned court below in connection with Patahi P.S. Case No. 04 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (S. Kumar, J) veena/- U T
