JUSTICE SUDHIR SINGH ORAL ORDER 16-03-2020 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner seeks bail in a case for the offence registered under Sections 341, 342, 323, 325, 307, 504 and 506/34 of the IPC.
The prosecution story, in brief, is that on 10.10.2018 at about 10.00 P.M. in the night, while the informant was returning after meeting to his daughter alongwith his son-in-law Ashish Goswami at that time near Ahilyabai Temple all the named accused persons including the petitioner started assaulting by Iron rod and Iron Pipe as a result of which, his son-in-law received injury, but anyhow he managed to escape and informed to the family members that the informant is being

In the meantime, he was brutally assaulted by accused persons as a result of which, he became unconscious. It is further alleged that he was admitted in J.P.M. Hospital from where he was referred to Magadh Medical College and Hospital, Gaya. They are threatening to compromise the cases which have been earlier instituted by him. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 17.09.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner and the informant are in the same profession of being Purohit.
Due to petty reason, some differences took place between the parties. The injuries are on non-vital part of the body of the informant. Hence, no offence under Section 307 of the IPC was made out. Other coaccused have been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 38401 of 2019 under order dated 13.09.2019 On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R.

No.79872 of 2019(3) dt.16-03-2020 3/3 the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Vishnupad P.S. Case No. 219 of 2018.
