2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 108 of the Bhartiya Nyaya Sanhita, 2023.
3. The allegation in the First Information Report is that the daughter of the informant had committed suicide on account of the fact that she was being pressurized by the petitioner for marriage.
4. It has been submitted by learned counsel for the petitioner that admittedly the petitioner was not present in the village during the relevant time when the deceased had committed suicide. Against the allegation of pressurizing the

No.84383 of 2024(3) dt.13-08-2025 2/3 deceased by phone, it has been submitted that during the course of investigation the CDR of the mobile phone of the deceased was checked and paragraph nos.49, 50, 51 of the same would clearly indicate that there is no talk with the petitioner rather the last call made from the mobile of the deceased was to one Md. Alam. It has been further submitted that the statement of another sister of the deceased, namely, Khushi Kumari, has been recorded in paragraph 38 of the case diary wherein she has made a reference to the relationships of the deceased with other persons and only in the end she has also made a reference to the petitioner that even he was interested in relationship and marriage with the deceased for which he was also exercising some pressure on her.
5. Learned counsel for the informant opposes the prayer for grant of anticipatory bail on the ground that the deceased had committed suicide on account of pressure exerted by the petitioner.

Taking the rival contentions into consideration which includes the fact that the call details do not show any last conversation with the petitioner and there is a vague allegation of being interested in getting married with the deceased, it appears that the ingredients of Section 108 of B.N.S., 2023
Patna High Court CR. MISC. No.84383 of 2024(3) dt.13-08-2025 3/3 would not be made out as no immediate proximity of any action of the petitioner has been shown towards leading to the death of the deceased. Let the above named petitioner, who has no criminal antecedent, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with East Colony P.S. Case No.45 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/482 (2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. (Soni Shrivastava, J) anand/- U T
