JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-07-2019 Admittedly, the provisions of the Bihar Public Grievance Redressal Act, 2015 are not attracted in the case of removal of encroachment since the same are governed by the provisions of the Bihar Public Land Encroachment Act, 1956. The short prayer made by the petitioner in the present writ petition is to direct the Circle Officer, Belaganj, Gaya to take the proceedings of the Encroachment Case No. 1 of 201617 to its logical conclusion. Having regard to the short prayer made by the petitioner, I deem it fit and proper to direct the Circle Officer,
Patna High Court CWJC No.7855 of 2018(4) dt.23-07-2019 2/2 Belaganj, Gaya to conclude the Encroachment Case No. 1 of 2016-17 by passing final order under Section 6 of the Bihar Public Land Encroachment Act, 1956, after considering the objections of the encroachers.
It is needless to state that the orders passed by the authorities under the Public Grievance Redressal Act, 2015, in the present case, would not have any bearing as far as Encroachment Case No. 1 of 2016-17 is concerned. The writ petition stands disposed of with the aforesaid directions.
