The petitioner seeks bail in a case registered for the offence punishable under Sections 20, 22, 23, 24, 25 & 29 of the Narcotic Drugs and Psychotropic Substances Act. 1 kg. of charas is said to have been recovered from the house of Gyan Kumar @ Gyan Sah and the said Gyan Kumar was apprehended who disclosed the name of the petitioner as one of his accomplices in the occurrence. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case. There is nothing

No.73930 of 2019(2) dt.11-12-2019 2/3 cogent on record indicating the complicity of the petitioner in the occurrence barring the confessional statement of Gyan Kumar @ Gyan Sah which has no evidentiary value in the eye of law. Petitioner has been languishing in custody since 16.11.2017. Similarly situated several co-accused, namely, Tabrej Alam, Akash Kumar Gupta, Ashraf Sai Ambuz @ Ashraf Sain and Ayub Gaddi @ Md. Ayub Gaddi @ Amjad Gaddi have been enlarged on bail by different co-ordinate bench of this court vide order dated 26.06.2018, 02.07.2018, 07.09.2018 and 17.05.2019 passed in Cr. Misc. Nos.19227 of 2018, 23286 of 2018, 39573 of 2018 and 30450 of 2019 respectively. Learned APP for the State opposed the bail petition.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge, West Champaran at Bettiah in connection with Bettiah Town P.S. Case No.511 of 2017, subject to the condition that the petitioner will appear before the learned Court below during trial as and when required and failure to appear on two consecutive dates without assigning any reason,
