1. Heard learned counsel for the petitioner and learned APP Sri Chandra Bhushan Prasad for the State.

2. In the nature of allegation as alleged in the FIR, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner as it has been alleged that on the night of occurrence, two unknown accused came on a motorcycle and fired at the gate of the jail and fled and name of the petitioner transpired during the course of investigation based on secret information and the petitioner was also identified by a witness Mantosh Kumar whose statement has been recorded at Para-31 of the case diary. Further, the petitioner also has antecedent of one case and the investigation is in the nascent stages as such, if privilege of anticipatory bail is granted, the petitioner may abscond.

3. Accordingly, the prayer of the petitioner for anticipatory bail stands rejected.
