JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Kesariya P.S. Case No. 179 of 2019 for the offence under Section 498(A)/34 of the Indian Penal Code, 1860 and Section 3/4 of Dowry Prohibition Act.

Allegation against the petitioner is that he has tortured his wife for non-fulfillment of demand of dowry. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. With reference to para 9 of the petition, counsel submits that the petitioner is ready to keep his wife with full honour and dignity, respect, comfort, safety and security.

Patna High Court CR. MISC. No.75971 of 2019(3) dt.06-03-2020 2/2 Learned counsel for the informant submits that the informant wife is also ready to respond accordingly. Considering the aforesaid, and in order to encourage restoration of normal conjugal life, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within one month from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Kesariya P.S. Case No. 179 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

In the event petitioner neglects, misbehaves or tortures the informant of this case, the Court below shall be at liberty to cancel his bail bonds.
