The petitioner is accused in connection with Dariyapur P.S. Case No. 373 of 2018, registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the FIR that on the basis of written report of Nand Kishore Rai, Dariyapur P.S. Case No. 373 of 2018 was instituted against three unknown with number of Maruti Car bearing registration no. DLC-2203 but in course of investigation, informant disclosed the name of petitioner and others with statement that they were involved in the present occurrence. In fact, neither informant nor any witness had

No.76337 of 2019(2) dt.08-01-2020 2/2 identified any culprits at the time of occurrence but in course of investigation, police got managed to implicated the petitioner in the present case showing the name of petitioner and others in the statement of informant and in the statement of witnesses. Further submission is that in the present case, petitioner is in custody since 30.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Dariyapur P.S. Case No. 373 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
