2. The petitioner has prayed for bail in connection with Biharsharif P.S. Case No.534 of 2024 registered for the offence punishable under Sections 305 (379 IPC) of Bharatiya Nayay Sanhita and later Sections 331(4) (457 IPC), 305(A), 317(4) (413 IPC), 317(2) (411 IPC), 3(5) (134 IPC) of BNS has been added.
3. The case of the prosecution is that on 11.07.2024 the informant and his wife were sleeping, when they woke up in the morning they found that the key at 10.00 a.m. on next day. When the Almirah was opened with the help of a mechanic the informant came to know that altogether jewellery worth six

The FIR was lodged against unknown miscreants, one Aditya Kumar was apprehended and he has given his confessional statement and in his confessional statement Aditya Kumar has stated that he has sold the stolen articles to the petitioner.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The learned counsel for the petitioner has submitted that though certain articles have been recovered from the possession of the petitioner TIP of those articles has not been conducted. It has also been submitted by learned counsel for the petitioner that the petitioner is a jeweler and he runs an ornament shop, so the recovered articles belongs to him, this is not the stolen article. Petitioner is having criminal antecedent of four cases and he is languishing in judicial custody since 20.09.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail
Patna High Court CR. MISC. No.84205 of 2024(3) dt.06-02-2025 3/3 bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Biharsharif P.S. Case No.534 of 2024.
