This application has been filed for modification in order dated 17.8.2019 passed in Cr. Misc. No.35371 of 2019 , by which the prayer for anticipatory bail was rejected, however, an observation was made that if the petitioner is ready to pay the same in installment, the learned court below shall consider the same.
Submission of the learned counsel for the petitioner is that he was ready to pay the same in installment but the learned court below is not ready to consider the same.
Patna High Court CR. MISC. No.80225 of 2019(2) dt.22-01-2020 2/2 In view of the submissions as made above, I am not inclined to interfere with the order. As such this application is disposed of. However it is made clear that when there is any observation by the higher court, it is expected that learned court below shall consider the same in its true spirit instead of throwing in dustbin.
