The petitioner is apprehending his arrest in connection with Sakara P.S. Case No. 268 of 2019 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a), 33, 34(B), 36 and 51 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that some raid was conducted at the house of the petitioner and it is alleged that certain recoveries were made. However, the same were not from his conscious possession and he was not present at the place of occurrence. Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Muzuffarpur in connection with Sakra P.S. Case No. 268 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
