The petitioner has filed the instant application for grant of bail in a case registered for the offence under sections 30(a), 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

As per the allegation in the FIR, 200 litres of Spirit is said to have been recovered from near the shop of one Ramashish Rai. It is further stated that the villagers assembled there and disclosed that the same belongs to this petitioner. It is submitted by learned counsel for the petitioner that from the FIR itself it would be evident that no recovery has been made either from the conscious possession of the petitioner or from the shop and he has no concern with the seized articles.

Patna High Court CR. MISC. No.74743 of 2019(2) dt.27-11-2019 2/2 He is in custody since 22.10. 2019 and has no criminal antecedent.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Saran at Chapra in connection with Panapur P.S. Case No. 200 of 2019 (District Chapra).
