The petitioner has filed the instant application for grant of bail in connection with Minapur P.S. Case No. 531 of 2019 (District Muzaffarpur) registered for the offence under sections 420 and 120(B) of the Indian Penal Code and sections 30(a) and 37(a) of the Bihar Prohibition and Excise Act, 2016. As per the allegation in the FIR, from the possession of the petitioner who happens to be the Officer-in-Charge of Minapur Police Station, 740 ml. and 350 ml. of IMFL were recovered from two different bottles.

It is submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent and is in custody since 12.10.2019.

The application for bail has been opposed by learned APP for the State.

No.73770 of 2019(2) dt.20-11-2019 2/2 Having heard learned counsel for the parties and taking into consideration the quantity of seizure together with the petitioner having no criminal antecedent and being in custody since 12.10.2019, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Muzaffarpur in connection with Minapur P.S. Case No. 531 of 2019 (District Muzaffarpur).
