JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Gaighat P.S. Case No. 302 of 2019, dated 07.09.2019, instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 174 litres of liquor is said to have been recovered from in front of the house of the petitioner, but near the fodder cutting machine.

There appears to be some possibility of the petitioner owning the aforesaid consignment of liquor. For the aforesaid reasons, I am not inclined to grant anticipatory bail to the petitioner.

However, should the petitioner surrender before the Court below within a period of four weeks and seek bail, the Court below shall consider the case on its own merit without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
