The petitioner apprehends his arrest in a case registered for the offence punishable u/s 126(2), 115(2), 109, 352 and 3(5) of the B.N.S.

Allegedly, all the F.I.R. named accused persons including the petitioner surrounded the informant and started abusing him. They have also assaulted the informant and his brother due to which they sustained injuries.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to dirty village politics. No such occurrence, in the manner as alleged, has ever taken place. There is previous enmity between the parties due to

Patna High Court CR. MISC. No.84346 of 2024(2) dt.16-12-2024 2/2 which the petitioner has been made accused in this case. The specific allegation against the petitioner is to assault the informant, whose injury was found to be simple in nature as per injury report, which is annexed as annexure 3 of the bail application. Petitioner has no criminal antecedent. 5.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, and the simple nature of injury, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Sheikhpura P.S. Case No.360 of 2024, subject to the conditions as laid down under Section 482(2) of BNSS, 2023.
