JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-12-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 13(c) of 2019, disclosing offences under Section 420 of IPC and Section 138 of N. I. Act. As per complaint case, the informant has taken Rs. 12, 50,000/- to the co-accused Shekhar Kumar Singh for treatment of his mother and an agreement paper was prepared, in which, one Gopal Singh is the guarantor and petitioner is said to be the witness.

Submission of the learned counsel for the petitioner is that except that he is a witness of that sale deed, there is nothing against him. He is ready to co-operate in disposal of the complaint case also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-V, Danapur, Patna, in connection with Complaint Case No. 13(c) of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition to co-operate in disposal of the complaint case.
