2. The petitioner has prayed for bail in a case instituted for the offence under Sections 302/34 of the Indian Penal Code.

3. As per allegation in the FIR, deceased had gone to his in-laws house where his mother-in-law with the help of two other family members assaulted him and he received sever head and his right eye injuries and he died. Thereafter, accused persons thrown his dead body in Koshi Ghat with a view to wipe off the evidence and fled away after locking the door. It is further alleged that in front of police, door of the petitioner's house was opened and bicycle, slippers, shirt and mobile phone of the deceased were found there.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner in mother-in-law of the deceased. No one is the eye witness of the alleged occurrence. Only on the basis of suspicion, name of the petitioner has been dragged in the present case. During investigation, no consistent material has come against the petitioner to show her involvement in the present case. Petitioner is a lady. Petitioner has got no criminal antecedent and he is languishing in judicial custody since 16.09.2023.

4. The application for bail is opposed by learned APP for the State.

5. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Araria P.S. Case No. 928 of 2023. (Sunil Kumar Panwar, J) sushma/- U T
