2. The petitioner seeks bail in connection with Shikarpur P.S.Case No. 308 of 2021 registered for the offence punishable under Sections 341, 323, 324, 354, 379, 504,34 of the Indian Penal Code and later on section 302 of the IPC was added.

3. The petitioner and other co-accused persons are said to have assaulted the deceased and the deceased died after 13 days of occurrence while in course of treatment.

4. The petitioner is in custody since 20.09.2021, having clean antecedent. Three witnesses, who have been examined in the trial including the informant have turned hostile.

5. Considering the facts and circumstance of the case, this application is allowed, let the above named, petitioner is directed to released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Shikarpur P.S.Case No. 308 of 2021,subject to the condition that he will co-operate in the trial.
