The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No. 595 of 2017 dated 27.11.2017 instituted for the offence under Sections 4/5 of the Explosive Substance Act, 1908.

The officer-in-charge of the concerned police station was informed that two miscreants of the area have snatched the money which was kept by a person for purchase of goat. After coming to know that the petitioner was one of the accused persons, his house was raided. Nothing incriminating was recovered from his house. However, the informant/officer-in-charge of the concerned police station spotted one person trying to escape from the house. He was apprehended and from

Learned counsel for the petitioner has submitted that an absolutely false case has been lodged against the petitioner. The petitioner earlier was made accused in one case in which he is on bail. The bomb which is said to have been possessed by the petitioner was never exploded. The seizure list witnesses are persons who hailed from the village as that of the informant.

The petitioner is in custody since 28.11.2017. Considering the aforesaid facts the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 595 of 2017.
