2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 190, 191(3), 231, 109, 118(2), 308(5), 332(c), 352, 351(2), 349(a) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. The case of the prosecution is that the petitioner along with others had threatened the informant/complainant and it is further alleged that on gun point, he has taken Rs. 1,00,000/- from the complainant/informant by entering into his house. Hence, the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the

It is further submitted that he has been implicated in this case due to his criminal history. The case which has been filed is only a counter blast of the case that the sister of the petitioner has filed a case against the informant/complainant. Moreover, the petitioner is languishing in judicial custody since 26.08.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Katihar Town P.S. Case No. 557 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar.
